KidsPACE Code Signatory Terms

Last updated: October 2026

1. About these terms

These terms apply to every organisation or individual that becomes a signatory to the KidsPACE Performing Arts Code of Practice (the Code). The Code is owned and administered by KidsPace Code Ltd (ACN 613 876 261) ("KidsPACE Code", "we", "us"). By creating a signatory account and confirming your agreement in the signatory form, you ("the signatory") agree to these terms.

2. Eligibility

Signatory status is open to dance and performing arts schools, studios, competitions, events, sole educators and any organisation offering creative education or services to children, including arts programs, community groups and schools. We may decline an application at our discretion.

3. Becoming a signatory

Signatory status begins when we have received your completed signatory form and signed Code, and have confirmed your status by email.

Why we collect your child safe policies. We collect your child safe policies to support your implementation of the Code, and to help us understand and strengthen safeguarding practice across the sector.

4. Your commitments

As a signatory, you agree to:

  • uphold the commitments of the Code across your organisation

  • maintain child safe policies and procedures appropriate to your organisation

  • comply with all child safety laws and obligations that apply to you, including Working With Children Check requirements and any child safe standards, reportable conduct schemes and mandatory reporting obligations in your state or territory

  • keep your signatory details up to date

  • tell us if your organisation's details or circumstances change in a way that affects your signatory status.

5. What signatory status means

A voluntary code of practice. The KidsPACE Code is a voluntary code of practice. It is not legislation and is not, nor does it seek to be, a legally binding document. It does not replace or override any legal obligations. Signatories remain fully responsible for complying with all relevant laws, regulations and statutory child safety requirements in their jurisdiction.

Not certification. Signatory status is a public commitment by your organisation to the Code. It is not a certification, accreditation, licence, endorsement or audit by KidsPACE Code. KidsPACE Code may review materials you submit and provide guidance to support your practice. Any review is not an audit, approval or endorsement, and KidsPACE Code does not guarantee the policies, practices or conduct of any signatory. You remain solely responsible for the safety and wellbeing of the children in your care.

Reporting concerns. KidsPACE Code is not a reporting or investigative body. Concerns about a child's immediate safety should be reported to police on 000. Other child protection concerns should be reported to the relevant child protection authority in your state or territory.

These terms. While the Code itself is voluntary, these Signatory Terms form an agreement between you and KidsPace Code Ltd. They govern your signatory status, access to resources, fees, and use of the KidsPACE name, logo and materials.

6. Founding period, fees and refunds

Founding Signatories. Direct signatories who join before February 2027 are Founding Signatories, with access at no cost until February 2027.

Annual signatory fee. From February 2027, an annual signatory fee applies to direct signatories. We will notify Founding Signatories of the fee at least 30 days before it applies, and you may choose whether to continue. If you do not take up the paid signatory option by the date we give you, your signatory status will lapse.

Payment and renewal. The annual signatory fee is payable in advance and renews automatically each year unless you cancel. We will send a reminder at least 30 days before your renewal date. You can cancel at any time to stop your next renewal, and your access will continue until the end of your paid year. If a renewal payment is not made, your signatory status will lapse.

Refunds. If you are not satisfied, you can request a full refund within 14 days of your first payment or of an annual renewal. After 14 days, fees are non-refundable, except where required by law. If we suspend or revoke your signatory status under clause 11, fees already paid are not refunded, except where required by law.

Signatories through Dance Arts Alliance. Signatories who join through Dance Arts Alliance (DAA) membership do not pay a signatory fee to KidsPACE Code. Signatory status through DAA continues while you remain an active DAA member and while KidsPACE Code's arrangement with DAA is in place. If your DAA membership ends, or the arrangement changes, you may continue as a direct signatory on the terms that then apply.

7. Access to KidsPACE in Practice

Your signatory login is for use by your organisation only. Please do not share login details or resources outside your organisation. Resources are released progressively, and we may update, change or remove resources over time.

8. Intellectual property

The Code, the Signatory Guide, KidsPACE in Practice and all KidsPACE resources and materials are owned by KidsPace Code Ltd. While you are an active signatory, you may use them within your own organisation to support your safeguarding practice.

You must not sell, publish, redistribute, or adapt for distribution any KidsPACE materials. You must not remove copyright notices or present KidsPACE materials as your own.

9. Use of the KidsPACE name and logo

While you are an active signatory, you may use the KidsPACE signatory logo and name in line with the guidelines in your Signatory Pack. You must not use them in a way that suggests KidsPACE Code has certified, accredited, endorsed or assessed your organisation. If your signatory status is suspended or ends, you must remove the logo and any references to being a signatory from your website, materials and social media within 30 days.

10. Signatory Directory

Listing on the KidsPACE Signatory Directory is optional. We may remove or decline a listing at our discretion, including where signatory status has lapsed, been suspended or revoked.

11. Withdrawal, suspension and revocation of signatory status

You may withdraw as a signatory at any time by contacting us.

Our right to suspend or revoke. We may suspend or revoke your signatory status if:

  • you breach these terms

  • you misuse the KidsPACE name, logo or materials

  • your conduct, or your organisation's conduct, conflicts with the principles of the Code

  • you, your organisation, or a person in an ownership or leadership role in your organisation is under investigation by police, a child protection authority or another regulator for alleged breaches of the law or child safety obligations, or

  • we become aware of information that, in our reasonable view, makes continued signatory status inappropriate.

Where a matter is under investigation, we will generally suspend signatory status until the matter is resolved, rather than revoke it. Where appropriate, we will contact you first to give you an opportunity to respond.

Signatories through Dance Arts Alliance. Dance Arts Alliance may revoke DAA membership under its own membership rules. If your DAA membership is revoked, your signatory status through DAA ends. KidsPACE Code may also suspend or revoke signatory status under this clause independently of any decision by DAA.

12. Limitation of liability

KidsPACE materials provide general guidance and do not constitute legal advice. You should seek your own professional advice about your obligations. To the extent permitted by law, KidsPACE Code is not liable for any loss or damage arising from your use of the Code or KidsPACE materials, or from the conduct of any signatory. Nothing in these terms excludes rights you may have under the Australian Consumer Law.

13. Privacy

We handle your personal information in line with our Privacy Policy. Where you become a signatory through Dance Arts Alliance, you consent to us confirming your membership and signatory status with DAA.

14. Changes to these terms

We may update these terms from time to time. We will notify signatories of material changes by email before they take effect. If you continue as a signatory after that, you accept the updated terms.

15. Governing law

These terms are governed by the laws of New South Wales, Australia.
